Know the Law Before Buying Property

Core Indian property acts, Supreme Court rulings, and regional land regulations simplified.

Core Principle

1. Sale Deed (Registration) vs Namjari / Dakhil Kharij (Mutation)

Under Supreme Court judgments, revenue mutation does NOT create or transfer legal title. It only records who pays municipal/land revenue taxes. To have safe ownership, you must hold a registered Sale Deed from the Sub-Registrar and update mutation in the local revenue circle.

Guwahati & Assam Rules

2. Assam Land Laws: Myadi Patta vs Eksona & Tribal Belts

In Assam, only Myadi Patta land can be legally sold and transferred. Eksona (annual lease) land is non-transferable without government conversion. Furthermore, under Chapter X of the Assam Land and Revenue Regulation 1886, notified Tribal Belts & Blocks have strict buyer class restrictions.

Delhi NCR Rules

3. Delhi Land Laws: GPA Sales Invalidation & Freehold Title

Following the landmark Suraj Lamp Supreme Court judgment, transactions executed purely on General Power of Attorney (GPA) and Agreement to Sell are invalid. Buyers in Delhi must verify DDA/MCD freehold conversion and registered conveyance deeds.
